A car that was driving erratically on the I-90 toll road in LaPorte County, Ind., struck and killed a highway worker on Oct. 2.
Dan Miller had just stepped out of the pickup truck he was riding in and was about to pull out grass-trimming equipment when he was hit by Hyundai Santa Fe driven by Paul Kimbrugh. Miller was pronounced dead at the scene, and Kimbrugh succumbed to his injuries later after he was airlifted to South Bend Memorial Hospital. Another maintenance worker driving the truck was treated for minor injuries.
The toll road maintenance truck was pulled over on the inner shoulder of the westbound lanes of I-90, and flashing lights and an arrow board were both turned on and functioning properly. A work sign also was posted in front of the operation.
Police dispatchers received a call shortly before the fatal accident about Kimbrugh speeding and driving erratically.
